Why analyze a competitor's product?

Sometimes clients analyze a competitor’s product as a part of an offensive licensing program to maximize the value of their intellectual property assets.  

 

Under other circumstances the best defense is a good offense.  If a patent is asserted against a client company, it is of strategic interest to determine how exposed their product line is to the client’s portfolio. A strong response back showing numerous cases of patent infringement by the competitor can derail a potentially costly legal issue.

 

It may also be very cost effective to do competitive analysis prior to entering a marketplace to best understand the technological coverage of current products as well as your current portfolio’s exposure to market penetration.
